  • Total THC limit of 0.3% applied to finished hemp products, including THCA
  • THCA concentrates and high-THCA hemp flower treated as controlled substances
  • No recreational marijuana; limited medical program
  • Hemp trace-level delta-9 THC may be available if not isomerized

THCA Laws in North Dakota β€” Full Breakdown

North Dakota bans cannabinoids created through isomerization or chemical conversion processes, targeting delta-8 and similar synthetic derivatives. The state also applies a total THC limit of 0.3% to finished hemp products, counting THCA toward this threshold. Most commercial THCA flower fails North Dakota's compliance standards.

THCA concentrates and high-THCA hemp flower are treated as controlled substances. The state's hemp-derived delta-9 THC trace amounts may remain available if they are not the product of isomerization, but the practical market for THCA is eliminated.

North Dakota does not have recreational marijuana, and its medical marijuana program does not provide an accessible alternative for the general THCA market. The overall legal landscape for THCA in North Dakota is restrictive.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
