THCA Laws in Colorado β€” Full Breakdown

Colorado enacted SB23-271 in June 2023, which prohibits chemically converted THC cannabinoids and applies total THC limits to finished hemp products. The law caps servings at 1.75mg total THC β€” a threshold that commercial THCA flower exceeds by orders of magnitude. Total THC calculation includes THCA, disqualifying all typical hemp-channel THCA flower.

Colorado was one of the first states to legalize adult-use cannabis in 2012, and the state has built a mature, well-regulated cannabis market over more than a decade. Hemp retailers selling THCA flower outside this licensed system are operating outside state law and face enforcement risk.

Licensed cannabis dispensaries in Colorado legally carry THCA flower under the adult-use framework. If you are in Colorado, purchasing from a licensed dispensary is the compliant route. The shift reflects Colorado's broader strategy of channeling all intoxicating cannabis products into the licensed marketplace.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.

All Leaflyx products are federally compliant hemp with COA documentation.
