New York's Office of Cannabis Management (OCM) formally classifies THCA flower as cannabis and requires it to be sold through licensed cannabis retailers. What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
