THCA Laws in Maryland β€” Full Breakdown

Maryland's Cannabis Administration requires all psychoactive cannabinoids β€” including those derived from hemp β€” to be sold through the state's licensed cannabis system. This means THCA flower, delta-8, delta-10, and similar products cannot be sold in general hemp retail stores or smoke shops.

Recreational cannabis became legal in Maryland in July 2023, creating a well-regulated market with licensed dispensaries. These dispensaries are the compliant channel for THCA flower. Hemp CBD non-intoxicating products remain available in general retail, but anything that produces intoxication falls under the Cannabis Administration's jurisdiction.

Attempting to sell THCA flower as a hemp product outside the cannabis licensing system is non-compliant under Maryland law. If you are in Maryland, a licensed cannabis dispensary is the legal and reliable source for THCA flower.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.

All Leaflyx products are federally compliant hemp with COA documentation.
