THCA Laws in Florida β€” Full Breakdown

Florida has not adopted a total THC standard for hemp products, meaning THCA content alone does not disqualify a product from legal hemp status. As long as delta-9 THC remains at or below 0.3% by dry weight, THCA hemp flower is legally sold at licensed hemp retailers throughout the state.

Senate Bill 438, which would have banned THCA flower and other intoxicating hemp products in Florida, failed in the House in 2025 for the second year in a row. The Florida hemp industry has mounted effective lobbying efforts to preserve the current framework. The Department of Agriculture oversees consumable hemp, with requirements for lab testing, proper labeling, and child-resistant packaging.

Age 21 and older is required for all hemp-derived products in Florida. Note that a federal law change effective November 2026 will redefine hemp to include total THC, which may ultimately restrict THCA flower unless Florida acts to preserve current access. For now, THCA flower remains widely and legally available.

What Is THCA and Why Does Legality Matter?

THCA (tetrahydrocannabinolic acid) is the raw, non-psychoactive form of THC found in fresh cannabis. Under the 2018 Farm Bill, hemp plants containing ≀0.3% delta-9 THC by dry weight are federally legal β€” regardless of THCA content. When THCA is smoked or vaped, heat converts it to psychoactive delta-9 THC through a process called decarboxylation.

Some states have added "total THC" standards that count THCA toward the THC limit. Others have banned smokable hemp specifically. The legal status of THCA varies by state and is subject to change as legislatures continue to address hemp regulations.
